On 15 September the Romanian government platform WorkinRomania posted an important notice: following a Bucharest Court of Appeal decision, the platform deactivated three flows — employer registration, employer authorisation and D/AM2 long-stay visa submissions. For recruitment agencies, this creates a short-term disruption and a clear set of decisions. Here are practical next steps.
1. Understand precisely what changed
The court suspended Order 1073/2026 — the rule that approved the list of shortage occupations. Because that list underpins the new system, the platform flows that depend on it were deactivated.
What this means in practice:
- Employer registration — paused on WorkinRomania.
- Employer authorisation — paused on WorkinRomania.
- D/AM2 single application submissions — paused on WorkinRomania.
It does not mean Romania has stopped all foreign-worker recruitment, or that all Romanian work visas have ended. The notice is specific about the platform flows.
2. Stop promising dates you do not control
This is the single most important action. The timeline is now partly outside your hands.
- Do not promise deployment dates.
- Do not quote processing timelines as if the platform were running normally.
- Do not tell candidates the position has "already resolved" without official confirmation.
3. Do not collect fees for a process that cannot be submitted
If a step cannot currently be submitted, taking money for that step creates a liability and damages trust.
- Pause fee collection tied to the paused steps.
- If you have already collected, communicate the position clearly and in writing.
- Keep complete records of every payment and communication.
4. Tell your candidates the honest position — now
Uncertainty handled honestly builds trust; uncertainty hidden destroys it.
A short, factual message works:
"Romania has paused three WorkinRomania platform flows following a court decision. This is temporary and the legal case continues. No payments are due for paused steps. We will update you when the official position changes."
Do not speculate on outcomes. Do not guarantee anything.
5. Keep the pipeline warm and ready
Verified demand, screened candidates and complete documents do not expire.
- Keep verified employer demand on file.
- Keep screened, documented candidates ready.
- Keep documents valid — especially passports and police clearances with validity windows.
When the flows resume, the prepared agency moves first.
6. Fix your document discipline now
The pause is a window to fix slow-moving problems:
- Passport validity — renew early where needed.
- Police clearance timing — avoid expiry before submission.
- Experience evidence — collect offer letters, pay slips and references.
- Consistency — check names and dates across every document.
Doing this during the pause means faster processing later.
7. Monitor the official source only
Rumour will move faster than fact. Use the official channel:
- workinromania.gov.ro — the government platform notice.
Ignore social-media claims and forwarded screenshots. If you cannot trace a claim to the official source, treat it as unverified.
8. Protect your candidates from fraud
A pause is when fraudsters flourish — "pay now, the door is closing".
- Warn candidates explicitly against pressure payments.
- Reiterate that no legitimate agency guarantees a visa.
- Remind them to never surrender their passport.
9. Scenario planning
Prepare for two directions:
- If the flows resume: you need verified demand, screened candidates and complete documents ready to move.
- If the legal position changes: you need an honest, documented communication plan for every candidate in your pipeline.
Either way, the same preparation serves you.
10. An agency action checklist
- ✅ Confirm the current position on the official platform.
- ✅ Pause promises of dates.
- ✅ Pause fee collection for paused steps.
- ✅ Communicate honestly with candidates, in writing.
- ✅ Keep verified demand and screened candidates ready.
- ✅ Fix document validity and consistency now.
- ✅ Warn candidates about pressure-payment fraud.
- ✅ Prepare a scenario plan for both outcomes.
